Terms and conditions

Article 1. Definitions

1.1 Terms and Conditions (hereinafter referred to as "Terms"): The following delivery and payment conditions apply to all sales through Galerie Judy van Meteren. By placing an order, you agree to these terms.

1.2 Company: Galerie is the trade name of Judy van Meteren (hereinafter referred to as "Galerie"), which is a supplier of Paintings, painted clothing and related products offered for purchase to consumers.

1.3 Consumer: a natural person or company entering into an agreement with the entrepreneur (hereinafter referred to as "Consumer").

1.4 Agreement: an agreement between Galerie Judy van Meteren and the consumer.


Article 2. Applicability

2.1 These terms and conditions apply to every offer by Galerie and to every agreement concluded between the company and the consumer.

2.2 These Terms and Conditions shall apply to all offers, orders, and agreements made using Galerie.

2.3 These terms and conditions will be made available via email and on the website, namely www.face-in-lines.com, before the agreement is concluded. Acceptance of an offer or placing an order implies acceptance of these terms and conditions.

2.4 Deviation from the provisions in these terms and conditions can only be made in writing. If any part of these terms and conditions is deviated from, the remaining provisions shall remain in full force. The consumer cannot derive any rights for future transactions from any agreed deviations.

2.5 Unless otherwise agreed in writing, Galerie does not recognize the general or specific terms or conditions of third parties.


Article 3. Agreements

3.1 An agreement is only concluded upon acceptance of your order by Galerie. 
Galerie is entitled to refuse orders or impose certain conditions on delivery unless expressly stated otherwise. If an order is not accepted, this will be communicated, with the reasons stated, within five (5) working days of receiving the order.


Article 4. Prices

4.1 All offers from Galerie are non-binding. Atelier expressly reserves the right to change prices, especially if necessary due to (legal) regulations.

4.2 The prices stated for the offered products are in euros, including VAT. Shipping costs are not included in the prices unless otherwise stated. The total price will be communicated via email before the agreement is concluded.

4.3 Shipping costs will be charged for deliveries within the Netherlands. For customers from countries other than the Netherlands, the contribution to shipping and insurance costs depends on the country.

4.4 Galerie cannot be held liable for price listings that are incorrect, such as those resulting from input errors, typographical errors, or printing errors. Unlawful price information does not grant any rights.


Article 5. Payments

5.1 Payment should be made as specified and indicated on the invoice. Payment is due within fourteen days after delivery. Additional (payment/order) conditions may apply to consumer orders. Upon placing an order, the consumer will receive an email confirmation with the total costs specified.

5.1.2 In case of the consumer's bankruptcy or suspension of payments (or a request for it), Galerie's claims and/or delivered goods become immediately due and payable.

5.1.3 If Galerie has to assign its claim for collection, the consumer is obligated to pay a fixed amount of 15% of the extrajudicial collection costs owed. If Galerie can demonstrate having incurred higher necessary costs, those will also be borne by the consumer.


Article 6. Delivery

6.1 All items are available from stock. However, it may occur that an item is unexpectedly unavailable. In such cases, the consumer will be notified as soon as possible. Different terms and conditions, to be determined by the parties, apply to custom-made products ordered by the consumer, where the product type, color scheme, and specifications are specifically determined by the consumer.

6.2 Galerie aims to ship all orders within 1 to 2 working days. This will be done through a postal service to the delivery address provided with the order. If the delivery time deviates for any reason, the consumer will be notified via email.

6.3 Exceeding the stated delivery time does not entitle the consumer to compensation, termination of the agreement, or non-fulfillment of any obligations arising from this or any other related agreement.

6.4 The order must be delivered to the consumer within 30 days from the date of the order. If it is not possible to deliver the order within 30 days, the consumer will be informed in a timely manner and has the right to cancel the order free of charge. In such a case, Galerie will arrange for a refund. This does not apply if the parties have agreed on a different delivery period.

6.5 Partial deliveries are allowed.

6.6 Galerie's delivery obligation is fulfilled once the delivery has been offered for the first time.

6.7 In case of refusal or failure to collect the offered delivery, return freight and storage costs, as well as the risk of damage or loss of the shipment, are entirely the responsibility of the consumer.

6.8 Offered products are clearly and truthfully depicted and/or described and as complete as reasonably required. However, variations in color, type, text, and/or price may occur.

6.9 Galerie is never responsible for consequential damages.


Article 7. Retention of Title

7.1 The ownership of delivered products only transfers to the consumer when the latter has fulfilled all obligations towards Galerie under the relevant agreements for the delivered products.


Article 8. Exchange/Return of Items

8.1 Galerie strives to provide information about the items on its website. If, for any reason, the consumer does not wish to accept an item without specifying a reason, they have the right to return or exchange the product within 14 working days of receiving the order.

8.2 During this period, the consumer should handle the product and packaging carefully. The product should only be unpacked or used to the extent necessary to determine whether it is desired to keep it. If the consumer chooses to exchange the product, it should be returned to the entrepreneur with all accessories provided and, if reasonably possible, undamaged and in its original condition and packaging, following the reasonable and clear instructions provided by the entrepreneur.

8.3 Galerie accepts returns/exchanges only if the provided instructions are followed. Returns and exchanges received after the stipulated time period will not be accepted.

8.4 The consumer will be responsible for the postage costs of returning items, which will be deducted from the refund amount.

8.5 For returning items from a country other than the Netherlands, the applicable postage costs, according to PostNL's standard rates, will be charged and deducted from the refund amount.

8.6 Upon receiving the returned goods, a confirmation email will be sent. The purchase amount for the exchange, minus the postage costs, will be refunded to the account from which the payment was made within 10 working days.


Article 9. Complaints

Complaints related to delivery and/or the quality of your order

9.1 We make every effort to deliver a perfect product. Upon receiving your order, you should inspect the delivered goods immediately and promptly report any defects in writing. If a product is not delivered as per your order, please notify us immediately. You can do so by sending an email to atelier@judyvanmeteren.nl.

This warranty expires if you attempt to repair the defect without consultation or fail to follow the instructions or usage instructions.

If you have such a complaint about an item purchased from Galerie, we would like to hear from you. You should notify Atelier immediately. You can do so by sending an email to atelier@judyvanmeteren.nl.

We will work to resolve the problem as soon as possible in consultation with you. In all cases, you must strictly follow the instructions for returning, as provided when you report your complaint, to facilitate the smooth processing of your complaint.

To ensure a smooth handling of your complaint, we kindly request you to strictly follow our instructions.


Article 10. Liability

10.1 Galerie expressly excludes any liability for all damages, of any kind whatsoever, direct or indirect, including business damage, consequential damage, damage to movable or immovable property, or damage to persons, arising from products from Galerie. Galerie is also not liable for any damage caused by third parties during the execution of the agreement.

10.2 Galerie accepts no liability for any damages resulting from the use of Galerie's products.

10.3 Galerie expressly excludes any liability for any (brand) products provided by the consumer for processing by Galerie. Galerie is also not liable for any claims related to the use of the (brand) products provided for processing by the consumer.

10.4 In any case, Galerie's liability towards the buyer is limited to the invoice amount that the buyer owes to Galerie under the relevant agreement.

10.5 Galerie is not liable for misunderstandings, mutilations, delays, or improper transmission of orders and messages resulting from the use of the internet or any other means of communication in the traffic between the consumer and Galerie, as well as between Galerie and third parties, insofar as they relate to the relationship between the consumer and Galerie, unless there is intent or gross negligence on the part of Galerie.


Article 12. Force Majeure

12.1 In case of force majeure, Galerie has the right to suspend the execution of the consumer's order at its discretion or to terminate the agreement without judicial intervention, by communicating this in writing. Galerie is not obligated to pay any compensation, unless this would be unreasonable under the given circumstances according to standards of reasonableness and fairness.

12.2 Force majeure is understood as any circumstance that cannot be attributed to Galerie because it is not due to its fault and is not at its expense according to the law, legal act, or generally accepted views.


Article 13. Applicable Law and Competent Court

These terms and conditions, as well as any rights, obligations, offers, orders, and agreements to which these terms and conditions apply, are subject exclusively to Dutch law.
